The Pollution Prevention Institute, through the Small Business Environmental Assistance Program, or SBEAP, provides environmental compliance assistance to Kansas dry cleaners. Many dry cleaners are regulated under three different bureaus and some of the requirements are difficult to understand.
This free and confidential compliance assistance is for Kansas small businesses that may need help understanding or identifying how the regulations apply to their facility, and is administered through our hotline, email, on-site visits, training events and and the various tools posted below. In addition to dealing with hazardous waste regulations, SBEAP also assists with air quality permits, storage tank regulations, and waste or stormwater permits. Special update: On December 18, 2024, EPA finalized a rule under the Toxic Substances Control Act (TSCA) that prohibits the use of perchloroethylene (PCE) in dry cleaning, with a 10-year phase-out plan. This means that the use of PCE in dry cleaning will be phased out over the next 10 years. Here are the key timelines that would apply to your facilities, based on the TSCA rule:
- 180 days after December 19, 2024: Any dry-cleaning machine acquired on or after this date cannot use PCE. This means if you were to purchase a new dry-cleaning machine now, it could not use PCE as a cleaning solvent.
- Three years after December 19, 2024: The use of PCE in third-generation dry cleaning machines and spot cleaning will be prohibited. The sources define third-generation machines as closed-loop systems where emissions are routed to a refrigerated condenser.
- Ten years after December 19, 2024: The use of PCE in all dry cleaning and spot cleaning, including in fourth and fifth-generation machines, will be prohibited. Additionally, manufacturing, processing, and distribution of PCE for dry cleaning will be prohibited.
